1. About These Terms

These terms and conditions (“Terms”) govern the supply of kitchen refinishing, uPVC spray painting, granite spray, furniture spraying, and colour matching services by ColourHaus Decorating Limited (“ColourHaus”, “we”, “us”) to our customers (“you”).

By accepting a written quotation or allowing us to commence work, you agree to these Terms. Please read them carefully before engaging our services.

2. Quotations and Acceptance

2.1 All quotations are provided in writing following a free home consultation and are valid for 30 days from the date of issue.

2.2 A contract is formed when you accept our written quotation by signing and returning it, paying a deposit, or providing written confirmation by email.

2.3 Quotations are based on the condition of the surfaces at the time of inspection. If, upon commencement of work, surfaces are found to be in materially different condition (e.g., previously undiscovered damage, delamination, or water ingress), we reserve the right to amend the quotation and discuss revised pricing before proceeding.

3. Payment Terms

3.1 Deposit: A deposit of 50% of the total quoted price is due upon acceptance of the quotation. Work will not be scheduled until the deposit is received.

3.2 Balance payment: The remaining balance is due on the final day of the job, upon your inspection and satisfaction with the completed work.

3.3 Finance: Where 0% interest-free finance has been arranged, payments are subject to the terms of the finance provider. ColourHaus is not the credit provider.

3.4 Late payment: In the event of late payment, we reserve the right to charge interest at 8% above the Bank of England base rate per annum under the Late Payment of Commercial Debts (Interest) Act 1998, and to recover reasonable debt recovery costs.

4. Cancellation and Consumer Rights

4.1 Consumer cancellation right: If you are a consumer and the contract was entered into away from our business premises or at a distance (including via telephone, email, or website), you have a statutory right to cancel within 14 days of accepting the quotation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

4.2 If you request that work begin within the 14-day cancellation period, you acknowledge that you may be liable for a pro-rata payment for any services already delivered if you subsequently cancel.

4.3 Cancellation after 14 days: If you cancel after the 14-day period, the deposit is non-refundable to cover preparation work, materials ordered, and scheduling losses. Where cancellation occurs after materials have been prepared, additional costs may apply.

4.4 Our cancellation right: We reserve the right to cancel a contract where surfaces are found to be unsuitable for refinishing, where access is not made available as agreed, or in circumstances beyond our reasonable control (force majeure). In such cases, deposits will be refunded.

5. Performance of Services

5.1 We will perform all services with reasonable care and skill, in accordance with the Supply of Goods and Services Act 1982 and the Consumer Rights Act 2015.

5.2 You agree to ensure clear access to the work area on the agreed start date. Where access cannot be provided and the delay is attributable to you, we reserve the right to charge for waiting time or reschedule at our discretion.

5.3 We will take reasonable precautions to protect your property. Protective coverings will be used in work areas. We are not liable for incidental damage that could not reasonably have been foreseen.

5.4 Completion timescales given at quotation stage are estimates. We will not be liable for delays caused by circumstances beyond our reasonable control, including supply delays, weather, or matters relating to the condition of your property.

6. Workmanship Guarantees

6.1 We provide the following written guarantees on completed work, subject to the conditions in clause 6.3:

6.2 Where a claim arises within the guarantee period, we will inspect the surface within a reasonable time and, if the claim is valid, carry out remedial work at no charge.

6.3 Guarantee exclusions: Guarantees do not cover damage caused by: physical impact or abuse; use of abrasive or inappropriate cleaning products; modification of surfaces after completion; failure of underlying substrate not discoverable at time of inspection; normal wear on high-use surfaces.

6.4 These guarantees are in addition to, and do not affect, your statutory rights under the Consumer Rights Act 2015.

7. Limitation of Liability

7.1 Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded by law; or breach of the implied terms under the Consumer Rights Act 2015.

7.2 Subject to clause 7.1, our total liability to you in connection with any contract shall not exceed the total price paid by you under that contract.

7.3 We are not liable for: loss of profit; loss of business; loss of anticipated savings; indirect or consequential loss.

8. Colour Accuracy and Matching

8.1 Where a specific RAL, Farrow & Ball, or manufacturer colour code is specified, we will apply paint mixed to that specification. Screen and monitor representations of colour are not guaranteed to be accurate.

8.2 Where colour matching is requested from an existing surface or sample, we will use our best professional judgement. Exact matching cannot be guaranteed where the original finish has faded, aged, or is from an unknown formulation.

8.3 We recommend you view physical colour samples before confirming your colour choice. Any changes to colour after work has commenced may incur additional cost.

9. Your Obligations

You agree to:

• ✓Ensure clear, safe access to the work area at the agreed start time
• ✓Ensure the work area is at a suitable temperature (above 10°C) for paint application
• ✓Remove all personal items and valuables from the work area before we arrive
• ✓Not use kitchen units or painted surfaces for the curing period specified at handover (typically 24–48 hours for light use, 7 days for full use)
• ✓Follow our aftercare instructions regarding cleaning products and surface care
• ✓Not apply any additional paint, varnish, or coating to refinished surfaces within the guarantee period without our written approval

10. Insurance

ColourHaus Decorating Limited holds public liability insurance. Details are available on request.

11. Disputes

11.1 If a dispute arises, please contact us in the first instance. We aim to resolve all complaints within 14 working days.

11.2 If a dispute cannot be resolved directly, you may wish to use an alternative dispute resolution (ADR) scheme. We will provide details of any relevant scheme upon request.

11.3 Nothing in these Terms affects your right to bring proceedings in the courts of England and Wales.

12. Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. General

13.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

13.2 No failure to enforce any provision of these Terms constitutes a waiver of our rights.

13.3 These Terms, together with the written quotation, constitute the entire agreement between us in respect of the services provided.
