1. Acceptance of Terms
By accepting a quotation, paying a deposit, instructing Colourhaus Decorating Ltd to proceed, permitting works to commence, or otherwise engaging our services, the customer confirms that they have read, understood and accepted these Terms & Conditions in full.
These Terms & Conditions form part of every quotation, invoice, proposal, work order and contract entered into with Colourhaus Decorating Ltd.
2. Nature of the Service
Colourhaus Decorating Ltd specialises in the refinishing, respraying and restoration of existing surfaces.
We are not supplying a new kitchen, new doors, new cabinets, new worktops, new windows, new furniture or new substrates unless specifically stated in writing.
All works are undertaken upon existing items, many of which may have unknown histories, defects, repairs, wear, contamination or age-related deterioration.
3. Existing Condition
All items are accepted in their existing condition.
The customer acknowledges that hidden defects may exist which are not visible during survey, quotation or initial inspection.
Colourhaus Decorating Ltd shall not be liable for defects, failures or weaknesses that existed prior to commencement of works whether visible or concealed.
4. Existing Paints, Coatings & Finishes
Colourhaus Decorating Ltd provides no warranty whatsoever regarding:
- Existing paint systems.
- Existing primers.
- Existing lacquers.
- Existing varnishes.
- Existing stains.
- Existing coatings.
- Existing wraps.
- Existing laminates.
- Existing vinyl finishes.
- Existing thermofoil finishes.
- Existing factory-applied finishes.
- Previous refinishing work.
We cannot determine how previous coatings were applied, what products were used, or whether they are suitable for refinishing.
Any failure originating within or beneath existing coatings shall be considered a substrate failure and not a failure of our workmanship.
5. Dismantling & Reinstallation
Professional refinishing often requires removal and reinstallation of:
- Doors.
- Drawer fronts.
- Shelves.
- Panels.
- Hinges.
- Handles.
- Drawer runners.
- Appliance panels.
- Decorative trim.
Whilst all reasonable care is taken, Colourhaus Decorating Ltd accepts no liability for age-related or pre-existing component failures arising during dismantling, transport, preparation, curing or reinstallation.
This includes but is not limited to:
- Broken hinges.
- Broken runners.
- Stripped screw holes.
- Failed fixings.
- Snapped screws.
- Brittle plastics.
- Failed soft-close mechanisms.
- Existing glue failures.
- Existing joint failures.
- Existing manufacturing defects.
6. Vinyl, Foil & Laminate Removal
Where vinyl, foil, laminate or wrapped finishes are removed, the underlying condition of the substrate cannot be known until stripping has taken place.
The customer acknowledges that the stripping process is exploratory in nature.
Additional defects may become apparent including:
- Water damage.
- Swollen MDF.
- Surface breakdown.
- Delamination.
- Adhesive contamination.
- Previous repairs.
- Surface distortion.
- Structural weakness.
Any repairs, reconstruction, stabilisation or additional preparation required following stripping shall be chargeable as additional works.
7. Additional Works
Quotations are based upon visible conditions at the time of survey.
If hidden defects, contamination, damage, structural issues or additional preparation requirements become apparent after work has commenced, Colourhaus Decorating Ltd reserves the right to revise the quotation accordingly.
Additional works shall be charged separately and must be agreed before proceeding.
8. Customer Responsibilities
The customer is responsible for ensuring:
- Adequate access.
- Safe working conditions.
- Removal of personal possessions.
- Removal of valuables.
- Removal of fragile items.
- Availability of electricity and water.
- Availability of parking where required.
Delays caused by lack of access may incur additional charges.
9. Colour Matching
Exact colour matching cannot be guaranteed.
Colour may vary due to:
- Manufacturing tolerances.
- Lighting conditions.
- Surface texture.
- Existing materials.
- Viewing angles.
- Digital devices.
Minor colour variations shall not constitute a defect.
10. Finish Expectations
Refinishing is not the same process as factory manufacture.
Whilst Colourhaus Decorating Ltd aims to achieve the highest possible finish, minor imperfections consistent with professional refinishing may occur.
Such imperfections shall not constitute a defect or basis for rejection.
11. Exclusions from Warranty
The warranty does not cover:
- Impact damage.
- Scratches.
- Chips.
- Abrasion.
- Excessive cleaning.
- Solvents.
- Bleach.
- Steam cleaners.
- Water ingress.
- Condensation.
- Heat damage.
- Appliance leaks.
- Sink leaks.
- Tap leaks.
- Silicone failure.
- Structural movement.
- Building movement.
- Third-party damage.
- Pet damage.
- Child damage.
- Contractor damage.
- Customer misuse.
12. Third-Party Contractors
Colourhaus Decorating Ltd shall not be liable for damage caused by builders, plumbers, electricians, kitchen fitters, cleaners, decorators, appliance engineers or any other third parties after completion of works.
13. Payment Terms
Ownership of all work remains with Colourhaus Decorating Ltd until paid in full.
Any warranty or guarantee shall be automatically suspended whilst any invoice remains unpaid.
14. Photographic Records
Colourhaus Decorating Ltd reserves the right to take photographs and videos before, during and after works.
Such records may be used to document condition, workmanship, defects and project progression.
15. Defect Reporting
Any alleged defects must be reported in writing within seven (7) days of discovery.
The customer must provide Colourhaus Decorating Ltd with reasonable opportunity to inspect and, where appropriate, rectify any proven defect.
No claim shall be accepted where third parties have carried out remedial work without our prior written consent.
16. Limitation of Liability
The maximum liability of Colourhaus Decorating Ltd under any circumstances shall be limited to the value of the works supplied.
Colourhaus Decorating Ltd shall not be liable for:
- Replacement kitchens.
- Replacement cabinetry.
- Consequential losses.
- Business losses.
- Loss of income.
- Alternative accommodation.
- Legal costs.
- Indirect losses.
- Special damages.
17. Warranty
Subject to all exclusions contained within these Terms & Conditions, Colourhaus Decorating Ltd warrants only that the coating system applied by us shall remain free from peeling, flaking or adhesion failure due solely to our workmanship for a period of five (5) years.
This warranty applies only to the coating system applied by Colourhaus Decorating Ltd and does not extend to any substrate, component, fixture, fitting, coating or material beneath it.
18. Entire Agreement
No verbal statement, representation, estimate, discussion, text message or informal communication shall vary these Terms & Conditions unless confirmed in writing by a director of Colourhaus Decorating Ltd.
These Terms & Conditions constitute the entire agreement between the parties.
19. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
